The terms for using Growth Plan

Plain-English terms for running a preview, buying a plan and sharing it. The short version: plans are AI-generated research from public sources, they are public unless you ask us to unpublish, and if you are not happy within 14 days you get your money back.

01Who we are and what these terms cover

Growth Plan (“the Service”) is provided by Programmable, LLC, a company registered under number [COMPANY REGISTRATION NUMBER] with its registered office at 3607 10th St NW, Washington, DC, United States (VAT number [VAT NUMBER, if any]). In these terms “we”, “us” and “our” mean that company, and “you” means the person or organisation using the Service.

These terms apply to the website at programmable.marketing, the free score preview, paid and free growth plans, plan refreshes, the public report pages, PDFs, exports and the emails we send about a plan. By running a preview, requesting or buying a plan, or using a plan’s edit link, you agree to these terms. If you use the Service for a company, you confirm you may accept these terms on its behalf.

Our Privacy Policy and Cookie Policy explain how we handle personal data and browser storage. They are part of how we run the Service but are not contract terms you agree to.

02What the Service does

You give us a company website domain. The Service then:

  • reads that company’s public website;
  • gathers public information from third-party sources, such as search results, review and directory sites, Reddit, GitHub, public filings (SEC EDGAR), job boards and Google’s Chrome UX Report;
  • sends that material to artificial intelligence (AI) providers, which analyse it and write a growth plan: findings, ten growth ideas, quick wins, bigger bets and supporting sections.

The plan is delivered as a web page at /growth-plan/<domain>, as a PDF and as exports (Markdown, JSON, CSV and formats for Notion and Linear). Whoever holds the plan’s private edit link can mark ideas as in progress, tried, done or rejected and add notes. We may email the address you give us about the plan (see section 9).

The free score preview reads only the homepage and makes one AI call. It is a teaser, not a plan.

03AI-generated content: no guarantee of accuracy or results

Plans are written by AI from public information gathered automatically. Please read them with that in mind:

  • They can be wrong. AI can misread a source, mix up companies with similar names, rely on out-of-date pages or state things with more confidence than the evidence supports. Each idea cites the finding it rests on so you can check it. Check anything that matters before acting on it.
  • They are not professional advice. A plan is general marketing and growth research. It is not legal, financial, investment, tax, accounting, employment or regulatory advice, and it does not replace a professional who knows your situation.
  • No promised outcome. We do not promise that any idea will increase traffic, leads, revenue or anything else. Scores, estimates and traffic models are indicative.
  • Public sources only. We do not log in to your systems or see private data, so the plan only knows what is public.

You decide what to do with a plan and you are responsible for the decisions you make and for checking that anything you publish or send (for example outreach copy) is accurate and lawful.

04Acceptable use

You may only submit a domain when one of the following is true:

  • it belongs to your own company or an organisation you work for or advise; or
  • you are lawfully researching a company you have a genuine business reason to research, such as a prospect, partner, customer or competitor, using information that company has made public.

You must not use the Service to:

  • harass, stalk, intimidate, defame or target any person, or build a profile of a private individual;
  • collect personal data about individuals for spam, unlawful direct marketing or any purpose that breaks data protection law;
  • submit domains in bulk or automatically, get around rate limits, overload the Service or the sites it reads, or use it as a general-purpose scraper;
  • probe, attack or test the security of the Service or any third-party system, or try to reach private networks through it;
  • break the law, infringe anyone’s rights, or breach the terms of the sources the Service reads;
  • resell or white-label the Service, or use its output to train a competing AI model, without our written permission.

We may refuse, pause or remove a plan, unpublish a report, or block access if we reasonably believe these rules have been broken. Where the problem was not caused by you (for example a technical fault), section 7 applies to any refund.

05Public plans and how to unpublish one

Plans are public by default. Each completed plan has a public page at programmable.marketing/growth-plan/<domain> that anyone with the link can open, and that search engines may index. The PDF, exports and a preview image for social sharing are available from that page. Recently completed public plans may be listed on our homepage as examples. Only the edit link, which we give to the person who started the plan, lets someone change idea statuses and notes; anyone can read statuses and notes on a public plan, so do not put confidential or personal information in notes.

Unpublishing. If you bought or requested the plan, or you represent the company it is about, email [email protected] from an address we can connect to the plan or the company and ask us to unpublish it. We will make it private, normally within five business days. A private plan, its PDF, exports and preview image return “not found” to everyone and it is removed from the examples list. You can also ask us to delete it entirely (see our Privacy Policy). Copies other people have already downloaded or shared are outside our control.

06Prices and payment

A growth plan is a one-time purchase (currently $199 in US dollars) and a plan refresh is a separate one-time purchase. There is no subscription and nothing renews. The price, and any tax added, is shown before you pay. We may change prices for future purchases; a change never affects a purchase you have already made.

Stripe is the merchant of record. Payments are handled by Stripe through Stripe Managed Payments. For the sale itself, Stripe (or its affiliate) acts as the reseller and merchant of record: it is the seller on your receipt, it calculates, charges and remits sales tax or VAT, and its own terms apply to the payment. We provide the Service you buy. We never see or store your full card details.

We sometimes provide plans free of charge or on request, for example while purchases are closed. These terms apply to those plans too, apart from the parts about payment and refunds.

The plan starts generating once payment is confirmed. It usually takes around 15 minutes, though it can take longer when sources are slow.

07Money-back guarantee and refunds

14 days, no questions asked. If you are not happy with a plan for any reason, email [email protected] within 14 days of the purchase date and we will refund the full amount you paid. You do not need to give a reason. Please include the domain and the email address or receipt you paid with.

If generation fails. If a plan you paid for cannot be completed, you do not need to ask. We will either re-run it at no charge or, if a re-run does not succeed or you prefer, refund you in full. The plan-failed email we send explains what happens next.

Refunds go back to the original payment method through Stripe. Stripe usually processes them within 5 to 10 business days, depending on your bank. After a refund the plan you received stays available unless you ask us to unpublish or delete it.

These promises are in addition to any rights you have by law (section 8) and do not limit them. We may decline repeated refund requests from the same person or company where the guarantee is clearly being abused.

08Consumer withdrawal rights (EU and UK)

Growth Plan is built for businesses. If you are a consumer in the European Union or the United Kingdom, the law normally gives you 14 days to withdraw from a contract for digital content. That right can end once supply of the digital content starts with your consent, which happens almost immediately after you pay for a plan.

Our money-back guarantee is at least as generous as that legal right: for 14 days after purchase you can get a full refund for any reason, including after the plan has been delivered. To use it, email [email protected] with a clear statement that you want to cancel or a refund. Nothing in these terms takes away any statutory right you have as a consumer, including your rights if the digital content is faulty or not as described.

09Emails about your plan

If you give us an email address, we send messages that are part of the Service: plan started, plan ready (with your edit link) and, if something goes wrong, plan failed. We may also send a reminder if a finished plan has not been opened after 48 hours, a short follow-up sequence (around days 2, 5 and 10) and weekly progress check-ins. Every one of these follow-ups contains a link to turn them off, and you can also ask us at [email protected].

10Intellectual property

Your plan. As between you and us, you own the plan output created for you, and you may use, copy, edit and share it for any lawful purpose, internally or with clients. To the extent we hold any rights in the output, we assign them to you on payment (or, for free plans, grant you a perpetual, worldwide, royalty-free licence). Third-party material quoted in a plan (for example review excerpts, public posts or filings) remains the property of its owners and is included for reference and commentary; your use of it must respect their rights.

Our Service. We own the Service itself: the software, research agents, prompts, design, the Growth Plan and Programmable names and logos, and the structure and layout of plans and reports. These terms do not give you any rights in them apart from using the Service as described here.

Examples. We may show a plan as an example of our work (for example on our homepage or in marketing) only while that plan is public, or in anonymised form with the company and any individuals made unidentifiable. If you unpublish a plan, we stop using it as an example.

Feedback. If you send us ideas or suggestions, we may use them without obligation to you.

11Third-party sources and services

Plans rely on third-party websites, data sources and AI providers that we do not control. Their content may be incomplete or wrong, and a source may be unavailable at the time a plan runs, in which case the relevant section is left out. Links to third-party sites in a plan are for reference; we are not responsible for those sites.

12Availability and changes to the Service

We aim to keep the Service available and plans online, but we do not promise uninterrupted access. We may change, improve or withdraw features. If we ever shut the Service down, we will give at least 30 days’ notice by email where we have your address, so you can download your plans as PDF or exports, and refund any plan that was paid for but not delivered.

13Limitation of liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law. If you are a consumer, nothing here affects your statutory rights.

Subject to that:

  • we are not liable for loss of profits, revenue, business, goodwill, opportunity or anticipated savings, for loss or corruption of data, or for any indirect or consequential loss, however caused;
  • we are not liable for decisions you or others make based on a plan, given that plans are AI-generated research and not advice (section 3);
  • our total liability to you for all claims arising out of or in connection with the Service or these terms, whether in contract, tort (including negligence) or otherwise, is limited to the total fees you paid us for the Service in the 12 months before the event giving rise to the claim. If you used the Service only for free, that amount is zero, apart from liabilities that cannot be limited by law.

Except as expressly set out in these terms, the Service is provided “as is” and we exclude all implied warranties and conditions to the extent the law allows.

14Indemnity

If you use the Service for business purposes, you agree to compensate us for reasonable losses, costs (including reasonable legal fees) and liabilities we incur because of a claim by a third party arising from your breach of the acceptable use rules in section 4, from content you add to a plan (such as notes), or from your use of a plan in breach of law or of someone else’s rights. We will tell you promptly about any such claim and let you take part in how it is handled. This section does not apply to consumers.

15Suspension and termination

You can stop using the Service at any time, and you can ask us to unpublish or delete your plans and personal data. We may suspend or end your access, unpublish a plan or refuse a purchase if you materially breach these terms, if we are required to by law, or to protect the Service, other users or the people and companies plans are about. Where the reason is not your breach, we will refund any plan that was paid for but not delivered.

Sections that by their nature should continue (including intellectual property, limitation of liability, indemnity and governing law) survive the end of these terms.

16Changes to these terms

We may update these terms, for example when the Service or the law changes. The “Last updated” date at the top shows the current version. Changes apply to purchases made after they are published; the terms in force when you bought a plan continue to apply to that purchase. If a change materially affects you and we have your email address, we will tell you before it takes effect.

17Governing law and disputes

These terms and any dispute or claim arising out of or in connection with them are governed by the law of [GOVERNING LAW / COUNTRY], and the courts of [GOVERNING LAW / COUNTRY] have exclusive jurisdiction, except that if you are a consumer you keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts.

Before starting any formal dispute, please email us so we can try to sort it out. Most problems can be solved quickly that way. If any part of these terms is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms without our consent; we may transfer ours to a company that takes over the Service, and we will tell you if that happens.
